TRAVELER RELEASE AND ASSUMPTION OF RISK

 RELEASE AND ASSUMPTION OF RISK

I (the below named participant) am aware that during the program, journey, trip, activity, teaching that I am about to engage can or may contain certain risks to my physical, emotional, mental or spiritual self or my belongings. These risks include but are not limited to, the hazards of traveling at high attitudes, on rivers and waterways, hiking, mountain climbing, retreats, forces of nature, travel by air, automobile, bus, boat and other modes of transportation on roads, mountains, waterways, land, accidents, loss of or damage to personal property, injury or fatality due to high altitudes, collision with vehicle, boat, rock, log, or tree, or offshore the capsizing of a boat or other vessel, accident or illness in a remote place without medical facilities, water damage due to leaking bags or other containers, exposure to temperature extremes and inclement weather, and other risks and dangers which may result in serious injury or death.

 With even partial payment or consideration of my privilege to participate in the aforementioned Activities and Services I hereby assume all risks and responsibilities, and voluntarily release and waive all claims against the Journey to the Andes and their affiliates, assistants, officers, directors, employees, teachers, agents, and representatives, or any of their family members and will hold them harmless from any and all liability, action, cause of action, debts, negligence, claims, demands and damages of every conceivable kind or nature whatsoever, whether direct or indirect, contingent, consequential or otherwise, arising out of, related to, or which may be brought by myself or a third party in connection with my participation in the Activity or any other activities arranged by, through, or with the Journey to the Andes. This agreement shall serve as a release, assumption of risk and responsibility and hold harmless provision for me, my heirs, executors, administrators and assigns, and all members of my family, including any minors.
 TERMS AND CONDITIONS

Reservations:
•        All reservations are subject to availability. A deposit is required to confirm your reservation. Final payment is due 60 days prior to the starting date of the program.
•        Persons with health or psychiatric problems may find some programs physically and mentally trying and risky. We recommend that in a case of doubt, a physician or mental health professional be consulted.
•        Due to the limited availability of space on our trip and the time required to process trip reservations your deposit of $500.00 will not be refundable.

Cost:
•        All prices are per person, double or triple occupancy
•        Single occupancy accommodation is available for an additional $500.00

Cancellation and Refunds:
•        Written notice of cancellation is required
•         60 days before the trips star date, all payments made to and received by Journey to the Andes, less your deposit of $500.00 will be refunded.
•        59 and 45 days, before the start date, the cancellation fee is 30% of the cost.
•         44 and 30 days, inclusive, the cancellation fee is 50% of the cost
•        29 and 1 day before the start, or if the traveler fails to attend without providing notice, the cancellation fee is 100% of the cost.
•         If a refund is approved, such refund will be made no sooner than 30 days after receipt of the written cancellation notice.
Insurance:
•        TRAVEL INSURANCE is recommended in order to protect yourself in case extenuating circumstances force you to cancel your trip and for baggage/loss protection as well. Baggage is carried entirely at owner’s risk.
•        Journey to the Andes or its affiliates assume no liability whatsoever for damages, delays or loss property.
Responsibilities:
•         Journey to the Andes reserves the right to accept or reject any person as a participant at any time, and to make changes in the itinerary whenever deemed necessary for the comfort, convenience, and safety of our participants, and to cancel a program at any time.
•        Journey to the Andes will do everything possible to hold the expeditions as scheduled, cancellations may occur for reasons beyond our control. Such cancellations may be the result of acts of God or force majeure (including, but not limited to, earthquakes, volcanoes, severe storms, floods, etc.), political machinations (including, but not limited to, war, closure of borders, etc.), terrorism or threats of terrorist activities, or acts of other third-parties (including, but not limited to, the canceling of reservations by conference centers, hotels, etc.).
•         If an expedition is canceled for reasons indicated in this paragraph, or for any other reason beyond the control of Journey to the Andes, then the traveler will be given a credit to attend a future expedition of the same nature as the canceled event for a period of two years. No refunds will be issued for cancellations beyond the control of Journey to the Andes.
•         Whether a cancellation is due to a request by the student, or whether the cancellation is initiated by the Journey to the Andes for any reason, in no event will Journey to the Andes be responsible for personal expenses incurred in preparation for or in relation to the canceled event. Such personal expenses may include but are not limited to, travel expenses, child care expenses, or any other expenses incurred by the traveler. The traveler acknowledges that any refund identified in these policies is solely for monies that have been paid directly to and received by Journey to the Andes as an expense for the subject event, and the traveler holds Journey to the Andes harmless for any other monies that the traveler may pay to third parties in preparation for or in relation to any expedition.

 I have read and agree to the above terms and releases.
